them info on my business because I think they may be interested in the program? I send none of my business info with this permission email and do not contact them again unless they request more info. So is asking a fellow business man/woman a simple question considered spam?

I would not so consider it. As long as your contacts are reasonably expected to be interested in what you are trying to sell, and you do not send subsequent messages without authorization, it would not be reasonable to criticize your activity.
